Affiliate Program Agreement

To be an authorized Affiliate of Hosting.MyMarkdown.com, you agree to abide by the terms and conditions contained in this Agreement. Please read this Agreement carefully before registering and using the Hosting.MyMarkdown.com Affiliate Program. By signing up for the Hosting.MyMarkdown.com Affiliate Program, you indicate your acceptance of this Agreement and its terms and conditions. If you do not accept this Agreement, do not sign up for the Hosting.MyMarkdown.com Affiliate Program.
  

1. Enrollment in the Affiliate Program
   To enroll in the Affiliate Program, you must submit a completed Affiliate Application Form. The Application can be found at http://hosting.mymarkdown.com/partners/affiliates/signup.cgi. We will evaluate your application and will notify you of your acceptance or rejection in a timely manner. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for our Affiliate Program for any reason, including, but not limited to, inclusion of content that is, in our opinion, unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable.
    
2. Revocation of Affiliate Status
   Your affiliate status as well as any pending commissions may be suspended or terminated by Hosting.MyMarkdown.com at any time for any reason. This includes but is not limited to:
   1. Inappropriate advertisements (False claims, misleading hyperlinks)
   2. Spamming (mass email, mass newsgroup posting, etc...)
   3. Advertising on sites containing/promoting illegal activities
   4. Violation of any of Hosting.MyMarkdown.com's TOS or AUP
        
3. Affiliate Links
   Affiliates may use graphic and text links on their website. The site may also be advertised "offline" in classified ads, magazines, and newspapers. Affiliated may use the graphics and text provided by us, or Affiliates may create their own as long as they are deemed appropriate by Hosting.MyMarkdown.com.
     
4. Affiliate Tracking
   When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username. Also, their IP address is tracked in the database along with your affiliate name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or the are using the same IP address as the one logged in the database.
     
5. Commission Determination
   Only sales tracked through our affiliate tracking system qualify for commissions. If a sale was not tracked by the affiliate tracking system, the Affiliate must contact Hosting.MyMarkdown.com within 7 days from the date of the sale to have it manually entered  into the system. Sales will not be manually entered into the system after 7 days from the date of the sale. If we determine (in our sole discretion) that a commission should be awarded to the Affiliate, there is a $0.50 fee to manually enter in a sale.
     
6. Commission Payments
   Affiliate will be entitled to receive 15% of the package sales price generated by customers who follow the special link from the Affiliate's web site to the Hosting.MyMarkdown.com web site. If a service that generated a commission is returned or not paid for, we will deduct the corresponding commission amount from the Affiliate's next payment. Payments will be mailed out at the end of each month provided that Affiliate has accumulated at least $50.00 in commissions. If Affiliate has not eared at least $50.00 in commissions, the amount Affiliate has earned will be carried over to the next month or until Affiliate has earned $50.00 in commissions. Commissions will be paid via Paypal.com.
     
7. General
   Affiliate will be considered an independent contractor in the marketing of Hosting.MyMarkdown.com's services. The relationship between Affiliate and Hosting.MyMarkdown.com creates no partnership, joint venture or similar agreement between Affiliate and Hosting.MyMarkdown.com. Affiliate will be held responsible for their own tax liabilities in relation to affiliate payments.
     
8. Miscellaneous - NO SPAM
   For the purpose of this agreement SPAM is defined as emailing anyone, in bulk or by single mailing, about Hosting.MyMarkdown.com, who has not specifically requested the information directly from Affiliate. Hosting.MyMarkdown.com also considers any type of advertisement about Hosting.MyMarkdown.com posted to a Newsgroup or Chat Room to be Spam. Affiliate agrees to not utilize SPAM in promoting Hosting.MyMarkdown.com. This action may result in the immediate suspension or termination of Affiliate account with a cancellation of any pending commissions. Affiliate will also be in violation of the Hosting.MyMarkdown.com Affiliate Agreement and subject to legal action and be held liable for any financial loss incurred by Hosting.MyMarkdown.com. Any service interruptions to Hosting.MyMarkdown.com as a result of Affiliates spamming will be billed to Affiliate at 100 U.S. dollars per hour until service is restored.
     
9. Terms of the agreement
   These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.
     
10. Liability
    We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.
